Court strikes out forgery case against ex-CAC President’s case
Court of Appeal sitting in Ibadan yesterday struck out the appeal filed by the immediate past factional president of the Christ Apostolic Church , CAC, Pastor Elijah Honward Oluseye and three others. Justice Abimola Adejumo Obaseki of the Federal High Court in Ibadan on September 19, 2013 ruled that Pastor Oluseye,the Chairman Christian Association of Oyo State, CAN and two others had a case to answer on allegations of conspiracy and forgery preferred against them by the federal government . Other accused in conspiracy and forgery case with Oluseye include ; the Chairman of Christians Association CAN, Oyo State Chapter ,Pastor Johnson Ayo Olabisi Pastor Gideon Okegwemeh, the general secretary of the general executive faction of the church, and Abdulhakeem Mohammed of Corporate Affairs Commission ,CAC, Abuja.
While delivering the ruling yesterday the Presiding Judge , Justice Dogban Mensem said the applicants had no appeal before the court of appeal because there is no record or evidence to show that the applicants had filed the case in the Court of Appeal . Justice Mensem who led other two Justices which include Justice A.A Gumel and Justice (Dr.) M.N Oniyangi further declared that counsel to the appellants had told the court that he did not have a copy of the main record of appeal which he said they had filed since 19th of December 2013. The presiding Justice Mensem noted that they cannot adjourn the case as prayed by counsel to the appellants because we don’t have record before us that can warrant us granting such request this case is hereby struck out .
